Acceptable Use Policy

This document should be read in conjunction with the JobSeal Platform Privacy Policy.
1. Purpose
This Acceptable Use Policy ('AUP') sets out the standards of conduct required of all persons who access or use the JobSeal platform ('Platform'), including candidates, employers, employer users, referees, and API integration partners. This AUP forms part of the binding agreement between each user and JobSeal Pty Ltd ('JobSeal').
2. Core Principles
All use of the Platform must be consistent with the following principles:
- Honesty: All information provided to or through the Platform must be accurate and not misleading.
- Fairness: The Platform must not be used in a manner that unfairly prejudices any individual or organisation.
- Integrity: The scoring and verification systems must not be manipulated, gamed, or circumvented.
- Privacy: Personal information accessed through the Platform must be handled with care and used only for its intended purpose.
- Legality: The Platform must not be used for any purpose that is unlawful or in breach of any applicable regulation.
3. Prohibited Uses — All Users
Regardless of user type, the following are absolutely prohibited.
3.1 Fraud and Misrepresentation
- Submitting false, fabricated, or misleading information in any form on the Platform;
- Impersonating another person or entity;
- Creating accounts using false or assumed identities;
- Providing fraudulent referee contact details or nominating fictitious persons as referees;
- Colluding with any other user to manipulate a candidate's score or employment record; and
- Offering, accepting, or arranging any payment or benefit in exchange for a favourable survey response.
3.2 System Integrity
- Attempting to access, probe, test, or compromise any part of the Platform's security infrastructure;
- Using automated bots, scrapers, or data harvesting tools to extract data from the Platform;
- Attempting to reverse-engineer the scoring algorithm or identify individual referee responses;
- Injecting malicious code, viruses, or harmful content into the Platform; and
- Interfering with the availability or performance of the Platform for other users.
3.3 Unlawful Use
- Using the Platform to facilitate discrimination on any basis protected by applicable law;
- Processing candidate data in breach of applicable privacy or data protection laws;
- Using the Platform in connection with any activity that is illegal in the user's jurisdiction; and
- Using any report or score data to harass, stalk, or harm any individual.
4. Additional Obligations — Employers
- Employers must not use candidate data to compile bulk marketing lists or datasets unrelated to active hiring decisions;
- Employers must not share, sell, or transfer access to candidate reports or contact information to third parties outside their organisation;
- Employers must not use the Platform's API to build competing products or to aggregate JobSeal data into alternative scoring systems; and
- Employers must ensure that hiring decisions made using JobSeal data comply with applicable equal opportunity laws.
5. Additional Obligations — Candidates
- Candidates must not create multiple accounts for any reason;
- Candidates must not attempt to identify or contact specific referees based on score outcomes;
- Candidates must not misrepresent their JobSeal or REFID to a prospective employer; and
- Candidates must not share their account login credentials with any other person.
6. Content Standards
Any content submitted to the Platform by users (including candidate statements, free-text fields, and dispute submissions) must not:
- Contain defamatory, harassing, threatening, or abusive material;
- Disclose confidential information belonging to a third party;
- Infringe the intellectual property rights of any person;
- Contain personal information about a third party without that person's consent; or
- Violate any applicable law.
JobSeal reserves the right to remove any content that violates these standards, without notice.
7. Reporting Violations
If you become aware of any use of the Platform that you believe violates this AUP, please report it to us at integrity@jobseal.co. We take all reports seriously and will investigate promptly. We will protect the confidentiality of reports where possible.
8. Consequences of Violation
Violations of this AUP may result in:
- Immediate suspension or termination of your account;
- Removal of content or score data associated with the violation;
- Referral to law enforcement or regulatory authorities where required;
- Civil or criminal proceedings by JobSeal or affected parties; and
- A permanent ban from the Platform.
JobSeal will exercise its judgement in determining the appropriate response to a violation, taking into account the nature, severity, and recurrence of the conduct.
9. Changes to This Policy
We may update this AUP from time to time. Material changes will be notified to registered users with at least 30 days' notice.
